ARBITRATION NOTICE: THE GENERAL DISNEY PINNACLE BY DAPPER LABS TERMS OF USE SET FORTH HERE (THE “GENERAL TERMS”) CONTAIN AN ARBITRATION PROVISION (SEE SECTION 16 OF THE GENERAL TERMS). PLEASE REVIEW THE ARBITRATION PROVISION CAREFULLY, SINCE IT AFFECTS YOUR RIGHTS. BY USING THE DISNEY PINNACLE BY DAPPER LABS APPLICATION (THE “APP”), OR ANY PART OF IT, INCLUDING YOUR ENTRY AND PARTICIPATION IN THIS SWEEPSTAKES, YOU UNDERSTAND AND AGREE TO BE BOUND BY THE ARBITRATION PROVISION IN THE GENERAL TERMS.

The Dapper Labs Event Sweepstakes (the “Sweepstakes”) starts on August 9, 2024 at 9 am PT and ends on August 11, 2024 at 7 PM PT (the “Sweepstakes Period”).

ELIGIBILITY: The Sweepstakes is open to Eligible Sweepstakes Entrants (“ESE”), who are defined as individuals that are legal residents (natural persons only) and physically located in one (1) of the fifty (50) United States or the District of Columbia, or Canada (with the exception of residents of Quebec), and who are present at the Disney Pinnacle by Dapper Labs booth at D23 (the “Booth”), who have installed the Disney Pinnacle by Dapper Labs app on their mobile device, who are eighteen (18) years of age or older (or of the legal age of majority in their state or province of residence, whichever is older) at the time of entry. Employees of Dapper Labs Inc. (“Sponsor”, “we”, or “us”), Buena Vista Books, Inc. (“Disney”) and its respective parents, subsidiaries, affiliates, promotion and advertising agencies, and members of their immediate families (spouse and parent, children and siblings and their respective spouses, regardless of where they reside) and persons living in the same household, whether or not related, of such employees, are not eligible to be considered as Eligible Sweepstakes Entrants and are not eligible to win a Prize (as defined below). Void where prohibited by law (specifically, in Canada, the Sweepstakes is not open to residents of Quebec). The Sweepstakes is subject to all applicable United States and Canada federal, provincial, state and local laws.

PRIZES: At the conclusion of the Sweepstakes, Sponsor will randomly select five ESEs who will each be awarded a maximum of one (1) prize (each a “Prize”) as described in the section below.

No purchase is necessary to enter or win. A purchase will not increase your chance of winning.

NO PURCHASE NECESSARY METHOD OF ENTRY: ESE’s will receive a maximum of one (1)
official entry into the Sweepstakes if they participate in the Disney Pinnacle by Dapper Labs D23 Trivia Questionnaire, which is only available at the Booth during the Sweepstakes Period. ESEs are not required to answer any of the questions correctly. ESEs will not receive additional entries for answering questions correctly. Entries become the property of the Sponsor and will not be acknowledged or returned.

PRIZE WINNER SELECTION: Sponsor will select the potential Prize Winners, using an
automated randomization tool, from among all eligible entries received during the applicable Sweepstakes Period. The Sweepstakes drawing will be conducted on or about August 19, 2024. The odds of winning depend on the number of eligible entries received.

WINNER NOTIFICATION: The potential Prize Winners will be notified by email no later than
August 20, 2024. The inability to contact, or receive a response from, a potential Prize Winner through email by 11:59pm EST on August 27th, 2024 may result in disqualification and forfeiture of the award, at Sponsor’s discretion, the awarding of the applicable prize to an alternate potential Prize Winner in a random drawing from among all remaining entries for the drawing at issue. The Released Parties (defined below) are not responsible for any delay or failure for a potential Prize Winner to receive notification from Sponsor, or for Sponsor to fail to receive a potential winner’s response, for any reason, including inactive account(s), technical difficulties associated therewith, or a potential Prize Winner’s failure to adequately monitor any account.

The Released Parties are not responsible for communications that are undeliverable as a result of any form of active or passive filtering of any kind, or insufficient space in an entrant’s email account to receive email messages. The Released Parties are not responsible for false, incorrect, changed, incomplete or illegible contact information. Any Canadian resident selected to win the Prize must correctly answer a time-limited math skill-testing question, in addition to otherwise satisfying all other Sweepstakes requirements, in order to be confirmed as the final Prize Winner.

GENERAL: ENTRANTS ACKNOWLEDGE AND AGREE BY PARTICIPATING IN THE SWEEPSTAKES THAT THEY MAY BE WAIVING CERTAIN LEGAL RIGHTS THAT THEY MAY OTHERWISE HAVE. By participating in the Sweepstakes, each entrant agrees: (a) to abide by these Official Rules and decisions of Sponsor, Disney Pinnacle by Dapper Labs Terms of Use, Dapper Service Terms of Use, and the decisions of the Sponsor, which shall be final and binding in all respects relating to this Sweepstakes; (b) to release, indemnify, discharge and hold harmless Sponsor, Disney, and its and their respective parents, affiliates, subsidiaries, and advertising and promotion agencies, and the respective officers, directors, shareholders, employees, agents and representatives of the foregoing (collectively, “Released Parties”) from and against any and all costs, claims, damages, (including, without limitation, any special, incidental, or consequential damages), or any other injury, whether due to negligence or otherwise, to person(s) or property (including, without limitation, death or violation of any personal rights, such as violation of right of publicity/privacy, libel, or slander), due in whole or in part, directly or indirectly, to participation in the Sweepstakes, or arising out of participation in any Sweepstakes related or Prize related Activity, or the receipt, enjoyment, participation in, use or misuse, of any Sweepstakes or Prize related activity, whether hosted by Sponsor or a Third Party; and (c) to the use of his/her name, voice, performance, photograph/video, image and likeness for programming, advertising, publicity and promotional purposes in any and all media (including digital media), now or hereafter known, worldwide and in perpetuity by Sponsor, Disney, and its and their designees, without compensation (unless prohibited by law) or additional consents from entrant or any third party and without prior notice, approval or inspection, and to execute specific consent to such use if asked to do so. By participating, entrants also agree not to release any publicity or other materials on their own or through someone else regarding their participation in the Sweepstakes without the prior consent of the Sponsor, which it may withhold in its sole discretion.

Prizes are awarded “as is” with no warranty or guarantee, either express or implied, including but not limited to, the implied warranties of merchantability, fitness for a particular purpose or non-infringement. Some jurisdiction may not allow the limitations or exclusion of liability for incidental or consequential damages or exclusion of implied warranties so some of the limitations or exclusions contained herein may not apply to you. Check your local laws for any restrictions or limitations regarding these limitations or exclusions. Prize winners may not substitute, assign or transfer their Prize, but we reserve the right, at Sponsor’s sole discretion, to substitute the Prize with another prize of comparable or greater value. The Prize Winners are responsible for all applicable federal, provincial, state and local taxes, if any, as well as any other costs and expenses otherwise associated with accepting any Prize. All Prize details are provided at Sponsor’s sole discretion. Sponsor will not be required to award more prizes than the number of available prizes set forth in these Official Rules. Each eligible person can receive a maximum of (1) one Prize. If an Entrant is found to have entered the Sweepstakes more than once or via more than one account (or multiple times from the same account), or has any other methods in an attempt to receive more than the permitted maximum entries, that Entrant will receive one (1) entry into the Sweepstakes and all additional entries submitted by the Entrant, regardless of method of entry, will be removed from the total number of eligible entries. Sponsor reserves the right not to award any or all Prizes if, in its sole discretion, it does not receive a sufficient number of eligible and qualified entries. All Prize awards are subject to verification of eligibility and compliance with these Official Rules.

In no event will the Released Parties be responsible or liable for any damages or losses of any kind, including direct, indirect, incidental, consequential or punitive damages arising out of your access to and participating in the Sweepstakes and/or downloading from and/or print material downloaded from any website associated with the Sweepstakes. Released Parties are not responsible for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Sweepstakes, including, without limitation, errors or difficulties which may occur in connection with the administration of the Sweepstakes, the processing or judging of the Sweepstakes, the selection of potential Prize winners, or the announcement of any prize. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by other entrants or site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Sweepstakes. Released Parties are not responsible for injury or damage to any person's computer related to or resulting from participating in this Sweepstakes or downloading materials from or use of the website. Persons who tamper with or abuse any aspect of the Sweepstakes or website, who act in an unsportsmanlike or disruptive manner or who are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified. Should any portion, or the entirety of the Sweepstakes be deemed illegal in any jurisdiction in the United States or Canada, Sponsor reserves the right at its sole discretion to suspend, modify or terminate the Sweepstakes.Should any portion of the Sweepstakes be, in Sponsor’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of entries, Sponsor reserves the right at its sole discretion to suspend, modify or terminate the Sweepstakes and, if terminated, at its discretion, select the potential winner(s) from all eligible participants using the procedures outlined above. CAUTION: ANY ATTEMPT TO DAMAGE THE Disney Pinnacle by Dapper Labs SITE OR TO UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION.


GOVERNING LAW: The Sweepstakes shall be governed by and construed in accordance withthe laws of the Province of British Columbia and the federal laws of Canada applicable therein without giving effect to any choice or conflict of law provision or rule (whether of the Province of British Columbia or any other jurisdiction).

DISNEY AND ITS RESPECTIVE SUBSIDIARIES, AFFILIATES, SHAREHOLDERS, OFFICERS, DIRECTORS, AGENTS, MEMBERS, REPRESENTATIVES, AND EMPLOYEES ARE NOT SPONSORS OF THIS SWEEPSTAKES AND WILL HAVE NO LIABILITY OR RESPONSIBILITY FOR ANY CLAIM ARISING IN CONNECTION WITH PARTICIPATION IN THIS SWEEPSTAKES OR ANY PRIZE AWARDED. DISNEY HAS NOT OFFERED OR SPONSORED THIS SWEEPSTAKES IN ANY WAY.
